Caixa facilitates the release of the balance from your FGTS account abroad, allowing withdrawals without having to return to the country. To do this, at least one of the following conditions must be met:
• Employment contract terminated by the employer without just cause.
• Normal termination of the fixed-term employment contract.
• Retirement granted by Social Security.
• The worker remains outside the FGTS regime for three uninterrupted years, in this case, withdrawals are permitted from the month of the account holder's birthday (see more information here).
• Permanence of the linked account for three uninterrupted years without deposit credit, for removal occurring until 3/7/1990.
In addition to an identification document with photo, work card and PIS/PASEP registration number, specific documents are required:
Wrongful dismissal:
• Term of Termination of the Employment Contract (TRCT) for contract termination until 01/31/2013, or Term of Homologation of Termination of the Employment Contract (THRCT) or Term of Discharge of Termination of the Employment Contract (TQRCT).< br> • In replacement of these documents, a copy of an unappealable ruling from the Labor Court may be presented, when the termination results from a labor complaint, or a Conciliation Term approved by the Court of the case or, also, a Term drawn up by the Prior Conciliation Commission.
• For non-employee directors, the Work Card and the TRCT/TQRCT or THRCT must be replaced by a copy of the minutes of the meeting that decided the removal or specific act of the competent authority.
End of fixed-term contract:
• Employment Contract signed by both parties, or CTPS pages which contain the contract for a fixed term and extension, if applicable.
• If there is no note of the fixed-term contract in the Work Card, a copy of the fixed-term employment contract must be provided.
• TRCT, for contract termination until 01/31/2013 - approved by the DRT or union when the contract is longer than one year, or THRCT or TQRCT. For the non-employed director, the Work Card and the TRCT/TQRCT or THRCT must be replaced by a copy of the minutes of the meeting that decided the removal or an act of the competent authority.
FGTS statement
To consult the FGTS statement and obtain information regarding the linked account, you can request:
• Statement of the FGTS linked account here (link http://www.caixa.gov.br/fgts/index.asp), registering a password, in case of first access.
• Statement provided at Caixa branches in Brazil through a power of attorney created specifically for this purpose by the account holder.
Withdrawal request
To make the withdrawal, obtain the FGTS Withdrawal Request form, go to a Brazilian Government consulate and present the duly completed form, in addition to the documentation (original and copy) that proves the right to operate the linked account. The FGTS Withdrawal Request must be signed in the presence of the consular representative.
The amounts will be credited to a bank account at Caixa or another bank in Brazil that you own. If you do not have a bank account in Brazil, you can indicate the account of someone you trust.
The resource is released within 15 business days after delivery of the documentation, subject to certification that the conditions required for movement of the FGTS linked account have been met.
